The INS sent letter to ask for more evidence on salary pay-off. My question is: Wether it is all right if the company has some loss, but the revenue shows the ability to pay off salary. such situation faces a lot of big companies, but they still have their people processed due to the size of the companies. My company is very small one.

Depends

"Small" is a relative term. Large companys have lots of assets that they can liquidate to pay salaries and continue operations. Small companies normally do not have these assets. If a company is showing losses it will be necessary to convince INS that the company does still have the capability to pay the stated salary. You know better than I do the probability of your company being able to do this.

Can we apply GC and got laid off and went to india.But canmy GC still process right now in LC

 
 
GC thru H1 is employment based and if you are laid off

then there is no GC process. You are still in very early stages of LC and in many forms you have to state how long you are employed, proof can be asked. You have to also show where you lived in past 5 years etc.
 
Surely someone is going to say "but, a GC is for a future position"

It\'s true that a GC is for a future position but there must really be a position available and a layoff certainly seems to indicate that a job for you is NOT available. It might be able to be done but I would certainly expect problems.
