I - 140 March 8th-May 20th APPROVED
Applied in Vermont on 8th March; transferred to TSC on May5th; Approved on May 20th.
EB-2.
Thanks for the help from the forum.
I have 2 questions though; my 6th yr expires next year.
Can I apply for H-1 extension based on this.
Can I change jobs by transferring H-1 and then apply for extension of H-1 from the new company.

You might want to get the current company to get a 3 year extension and then get the new company transfer that H1. That way if the current company gets pissed off and decide to cancel the I140 you have the H1 and 3 years is a long time to get the green card process restarted. If the current company doesnot cancel the I140, you can use that or just get the new company to do a PERM and you will be back where you are pretty quick.
I have the same modus operandi planned!!! HeHeHe

One word of advice from someone thats been burnt

Get it in writing from the new company that the will sponser your GC and start the process right now. They dont have to wait for the H1 or the even the receipt notice.

Good luck

Someone told me that i cannot apply for extension of H-1 before 6 months of the expiration. Hence I cannot do it now from my company if that is true? What do u think?
Also is the extension of H-1 contingent on the new company doing the GC or it does not matter?

NYC8300,

Congratulations !!!

I think USCIS might not honor your H1b extension beyond 6 yrs before that time has reached... they might give you H1b for one year and then you can always apply again near the end of 6th year for further extension for 3 years increement. It doesnt hurt to ..try requesting them to apply those provisions now itself...

By the way, can you share information If you had seen LUDs prior to you I-140 approval notice.

Thanks and good luck !

I saw notices from USCIS on the 8th of March for receipt of I-140 application in Vermont and then on 5th of May for transfer from Vermont to Texas and then on the 20th of May on approval.
There were standard disclaimers about the approval to take 400+ days but it seems they are working.
