I-140 is Denied. What other options do i have?

Hi,

I have applied for Labor in EB2 category(Based on Masters degree) and got it approved. I applied for I-140 and was denied as my Masters degree is not from an accredited university. Is it possible to use my old labor/priority date and file a new I-140 in EB3 category? or do i have to go from scratch i.e., apply for a new labor in EB3 category. What other options do i have now?

Please let me know your suggestions?

One of the hazards of applying in EB2 when not qualified for it - What is your attorney advising? Do you have similar problems with EB3, i.e. is yours a 3 years bachelors degree?

I have 4-year degree. but is there any way i can get my old priority date with new filing?
 
You can re-file in EB3 only if you have the EB2 qualifications but the job description in the LC doesn't.
