I-140/II-485 update

Hi Guys

I am ready to file I-140/II-485. My wife had Optional Practical Training after finishing her Bachelor degree in computer information system. She did not have a job in computer first 8 month. She worked in Burger King. Now My Attorney told me that might be a problem.

Is OPT just for degree related job?
Is there any way?


I really appreciate you any input.

From what I hear, understand and know, OPT cannot be used for working in Burger King. It has to be a job related to the Bachelor's degree. I am sorry to let you know that this might cause serious problems. Talk to an experienced immigration attorney ASAP. Good luck!
 
OPT should be used only for academic related field. It will be a hard time to prove working at Burger King is somehow related to computer science...

What kind of OPT was she working on ? Practical OPT or C OPT

Practical OPT has some leverage... Good Luck
