I-140/I-485 denial question.

Hello.

My I-140 was denied by "hability to pay issues" in June 2004. This also denied my I-485, both I-140/I485 were filed concurrently on Sept 2003
Later my lawyer appealed and my I-140 got approved and my I-485 was reopened on a bcis motion on October 2004.

My question is:

What date is the BCIS going to use now to adjudicate my case?
Is the original ND Sept 2003 or will they now use October 2004 because of the appeal?

Can anyone pls throw some lights on ability to pay issue..My company is very small..And i am afraid that my I140 could be denied on this issue..
Do the people working in small consulting companies get these type of RFE's :confused:
 
When your lawyer prepared the I-140 filings, he should have included financial information from the company to show that the company is able to pay your salary. If he didn't include this, then you are very likely to receive an RFE requesting your company's financials.

can u please share why u were issued an RFE? ( was ur company too small or financially weak? or ur attorney just didnt submit the necessary papers?)

what steps did u take to address the issue and get ur RFE approved?
