Hi,

I'm applying for I-140/I-485 Concurrent filling (EB2-NIW) and I also would like to fill I-765 (EAD) and I-131 (AP).
My current status is J1 (for the primary applicant) and J2 for my wife (dependant) till December 2009. Meanwhile, the university where I'm working is applying for an H1-B for me and H4 for my wife.

1) Should I write a cover letter for EAD for both? (my wife and me). In my case is a new one, but my wife has an EAD through J2 (is this considered as a renewal or a new one?)
2) Is it possible to apply for AP while my University is applying for an H visa? Are there any conflict if both are granted?
3) Should I write a cover letter for Part 7 of I-131? I suppose that I have to...

Thanks!

1. If it's all in one package, you don't need to write a cover letter for each application, just one cover letter for the whole package (I doubt USCIS even looks at cover letters by the way). Since this is a different category for your wife, (C-9 and not C-5), it is not a renewal but a new application.

2. No conflicts since each is a separate document - one (the H) is a change of non-immigrant status, the other (AP) is merely a travel document.

3. Well, just a very brief paragraph would work - again, since you're applying for AP based on a pending I-485, I doubt USCIS even looks at that letter (perhaps they only look to see that it's there without actually reading it).
