I-140/I-485 Approved & I-551 Stamped

Hi Friends,

I have been a silent user of immigration.com. I used to spent a lot of time and got lots of queries answered. My sitution was a bit unique so decided to post the details.

1. I was working for a company in LA, got pre approved labor (Priority Date 09/01-EB3) and filed I-140/I-485 for myself, spouse and daughter on 04/20/04.

2. Got FP notice in May and EAD approval for myself and my wife in June.

3. In june my company got acquired by another company. New company filed I-140 ammendment in Aug 04.

4. New company filed AP in July 04 and I got approval in Sep 04. My wife lost her EAD in September and we filed a police complaint. In sep end my wife and daughter left for India.

6. New company asked me to move to Bay area and start the new assignment from Nov 01, 04. I moved to Bay area and filed change of address and updated the address for I-485.

7. I left for India in Nov end and Came back in DEC end with my family. Though I had AP for myself and my family we used our H1&H4. As my Attorney had suggested that if you have your H1 stamped use that instead of AP.

8. I came here on Sunday and checked my status and found that our applications have been approved when I was in India.

9. Today I went for I-551 stamping and our passport got Stamped. I just let the ins. know that my wife has lost her EAD. She didn't even ask any questions.

First of all congratulations ..

I have a couple of questions for you,
1) When your company got acquired in june, did ur attorney ask you to file for amendment ? What if you didnt file an amendment ?
2) Does the new company have to file for a new EAD and AP after acquisition ?

If your application (I-140) is pending for less than 180 days with INS and your company got acquired, an ammendment needs to be filed by your new company. This is INS Rule.

2) Does the new company have to file for a new EAD and AP after acquisition ?

No.
