I-140 Form questions

Hi Guru's,

I have my I-140 approved from my current employer, and I am currently working there. I have a different company who is ready to file my I-140, and once i am thru this hassle than I am also planning to join that company.

My question is what happens to my first I-140 if new one gets denied for some reason.

Also what extra documents we need to send along with new I-140 application.

In I-140 form Part 4 question 6
Has any immigrant visa petition ever been filed by or on behalf of this person?

Also,

Part 6, Question 8, Is this a new position?
The position is currently exists and is occupied with a guy holding H-1b visa. Company is offering me that position and will let that guy go after I join.
So technically this is not a new position, but currently I am not holding that position. So what should be my answer to this question.

I asked my lawyer and got a unsatisfactory answer.

Any help is greatly appreciated.
