Gurus,
I used to work for a Company A for the last three years. The Company A had applied LC for me in Mar 2003 which has got approved now. I left Company A in Mar 2005 and am currently working in Company B.
The company A is willing to continue my GC applcation for a future position, since I am not their current employee anymore. I have the following queries,
1. Do we need to submit some Emp. verification letter with I-140? In my case of future employment, has this letter to be in a different format expressing interest to hire me in future (after GC approval)? Or its the same kind of letter offered in both regular and future employment case?
2. For ability to pay issue, should I submit W-2 that I got from company A from 2003 and 2004, alongwith company financial documents? I have not seen financial documents as of now, so I have no idea if they would satisfy the requirement. So, I thought the W-2 (from LC priority date to till I left) may help, but then again its a future employment case (although I worked for same company A before)
3. Do we have to specify in I-140 that its future employment case at all? I mean does it matter to INS if its a future or current position. I thought all they care is - ability to pay AND candidate's suitability.
I am sorry for the long post, but I would appreciate if anyone could answer or give some useful pointers for my case.
