I-140 Finally Approved

Hi All

Yesterday My I-140 was Approved. Here are the details


I-140 (did not apply for I-485)

ND: 25 NOV 2002
RD: 04 DEC 2002
RFE: 05 NOV 2003
Did NOT receive RFE until 10 DEC 2003
Attorney called and asked for resend of RFE
RFE Re-sent: 10 DEC 2003
RFE received: 13 DEC 2003
RFE: Original Copy of Labor
RFE Received by INS: 31 DEC 2003
I-140 Approval: 22 JAN 2004

I take this oppurtunity to Thank one and all who from time to time contributed their views, ideas, info etc

Getting ready to apply for I-485
Question: Everything is fine except that I worked only 3 months EACH in 2002 and 2003 and my W-2 amounts for these 2 years are very very low

My attorney is asking for copies of last 3 yrs of tax returns and
W-2 forms

I am afraid what will happen to my I-485???
How important are the tax returns and W-2 forms at I-485 stage

Note: I already submitted 3 years tax returns and W-2s from 1999, 2000 and 2001 when I applied for I-140


Please advise me.

Enjoy your time. You can't with the questions regarding tax return for I485.

you should have applied concurrently to avoid all these problems. Some justifications should be given I guess for low W2 returns. A good attorney would take care of it.

An experienced attorney, specializing in immigration and labor laws,
is what you should look for ASAP.

How important are the tax returns and W-2 forms at I-485 stage
They want to see you are contributing taxes and employed as per your
LCA/I-140. There are people who have filed I-485 by themselves, check
other threads on this forum. If you are between projects, you are better
of consulting an attorney, also watch knowledgable contributors(gurus)
on this site for options.
 
w2's are not mandatory

Don't worry about w2's now.You can apply 485 without submitting W2's.They might/mightnot issue RFE for W2's later.
Ask your attorney to submit 485 without W2's as it's not mandatory.
Guy's please correct me if i am wrong.

What Arzootech said was right. You please go ahead applying for I-485 without W2's. By the time (if) USCIS send you a RFE you will be having atleast two years complete W2's starting from now in your hand.

I am thinking of including tax returns and W-2s from 1999, 2000 and 2001 (i still didn't file tax return for 2003) and I will include my 3 recent pay stubs (as asked by attorney). I will also be including Employment Letter and the rest of usual documents required for I-485

will there be any RFE's in future?
