I-140 filing question!

Case#2 Sept'07 (perm) EB3
Labor Approved - Nov'07
I-140 - Planning to file

1. If I file I-140 for the 2nd case, is it going to impact my case#1 or both can be processed independently?

2. If Case#2 I-140 gets rejected, is it going to impact Case#1 I-140 stage or 485 stages.

3. If case#2 I -140 gets approved prior to Case#1. Can I use case#1 priority date for the case#2.

4. If case#1 I-140 gets approved then should i still continue the case#2 ?

Very confused, should i go ahead with I-140 filing for the 2nd case or not?

Please advise.

I-140 is to verify the employer's ability to pay and beneficiary's education, work experience etc to satisfy the job in the LC. I would not take any chances to jeopardise the I-140 filed for case #1.
 
When 2 similar applications (say I-140) are pending the newer one overrides it's older counterpart. I am not sure how it works (please ask your lawer) but if the above happens then you may loose the priority date from the case #1. I would abstain (or wait till the pending I-140 is adjudicated) from moving to case #2 unless it is urgent.
