Hello all,

Can someone please tell if a future employer can file I-140 (EB-1) for an employment to start after I140 has been approved?
Or one has to be on the job already for filing i-140?

Thank you!

1- Yes
2- Yes/No

Hi Assur: Thanks for your reply, can you please explain your answer: "yes/No" on my question that if one has to be on the job already for filing i-140?

Thank you.

I will be really grateful.

1- GC is for future job that is correct.
2- While working for the same employer you can file/start your GC process. Or if you are working for different employer A, Employer B can file your GC.
so 2 is the combination of yes/no. Yes (you can start GC either way), No (your are not required to work for employer pre-GC)
