I-140 Filed in Mar'04, I485 Filed in May'04 at VSC

I filed my I-140 application with a substitute labor in EB3 category at VSC on March 08th 2004 and my I-485 application in May 2004. I received my EAD and AP approvals from VSC in July 2004 and I didn't extend my H1B after my 6 yr period completion in Dec'04. My questions are below:

1. Will my I-140 and I-485 applications in anyway come under the retrogession rules? Do I have to wait for Priority Date to reach to get my I-140 or I-485 applications approved?

2. Even though VSC is currently processing I-140 applications filed in Dec'04, I have not received my approval so far. What could be the reason for the delay in the approval of my application?

3. What's your general opinion about my Case?

Only 55% of I-140s filed in March 2004 have been approved according to immigrationwatch.com

You are taking a risk not extending your H-1 because if you are denied you will be out of status and have to leave the country within 120 (?) days versus the remaining time on your H1 if you extended.

I don't know about retrogression or substitute labor.
