Can some one please help me:-
1) My labor was approved in company 1 in EB3 with priority date June 6, 2003.
2) Later I changed my job and the 2nd company also started the GC process and filed perm under EB2 category with a priority date of Dec 2006.
My I-140 under EB2 was approved in May 2007 for the second company and the 2nd company is ready to file I-485.
My Question:-
Can I still file I-140 from my previous company under EB3 and transfer the priority date to the current compay even though I-140 under EB2 has been approved before filing I-485 from the 2nd company?
My previous employer may be willing to help me.
