My I-140 got denied. I did process concurrent I-140 and 485 on EB2. They denied because of three years bachelor degree is not equivalent to US 4 years bachelor degree. I have total 15(10+2+3) years study and 2 years computer diploma. USCIS said that If don't appeal within 30 days then the descision is final. My question is that:

1. If I do appeal what will be the status of I-140 and 485?
2. Can I still working (H1-B will be expiring Dec 7th, 2006, can not extend because labor was done less than 365 days)
3. Is there any one who can evaluate properly or any one like my status?

Thanks.

As far as I understand, if you have 3 yrs bachelor then in addition to that you need to have 3 yrs of work experience to be eligible as US equivalent 4 yrs bachelor degree. Now to be eligible under EB2 category which requires bachelors plus minimum of 5 yrs experience, I am not sure if you need minimum of 8 yrs (5+3) of work experience. If you clarify how many years of work experience you have, I am sure it would be easy for other experts to answer your question. Again I am not an expert, please clarify with others.

I have total fifteen years experience. Is there any option that you can use your experience with three years bachelor degree to make US 4 years bachelor degree equivalency? Anybody has any idea?

Thanks.
