Hi All,
I applied for I-140 in EB1/OR by my company.
My profile in petition was:
1) 9 publications in conferences, Approx 15 citations + 3 University Technical Reports.
2) 1 USPTO Approved Patent, 4 Pending patents
3) Few IETF Working Group drafts
4) 7 Letters of recommendation from industry experts.
5) MS in CS, Total 7 years exp, 3+ research experience.
6) Served in TPC and peer reviewed conference papers...
USCIS has issued Notice of Intent to Deny - saying
a) I could not meet requirement for original scientific and scholarly publications for being an outstanding researcher
b) and not an author of scholarly books and articles
for which they explained that readership of IETF is limited to working groups only and drafts have not been implemented by IETF yet. Technical reports are not like journals with re-ocurring readership. Conference readership is only to conference attendees only. Patents do not necessarily mean that they have an impact on field.
In reality, RFC's are already standards which are adopted by many companies for interoperability. There are 300 RFC's published in 1 year and More then 1,00,000 patents filed. Ofcourse, RFC's are related to only internet related ************.
My question is what should I do now to get an approval ?
Between the filing of I-140 and now, I have 1 more patent approved by USPTO, 1 more paper and 1 IETF draft became an RFC standard. But, new evidence cannot be submitted now.
Any advise on what should be my way to convince the officers would really help ?
