Here is my story.....Last year my attorney e-filed I-140 just a couple of days earlier to the PD fiasco (during June/July 2007). As all the PD dates became current last year during the fiasco, he withdrew the old e-filed application and concurrently filed the I140/I485/EAD/AP.
After a couple of months he got an RFE on the old e-filed I-140 for the lack of documentation because he did not send any supporting documentation as he thought it was not necessary coz he withdrew the application. To be on the safer side, he sent all the supporting documentation requested by the RFE for the old e-filed application and after that there is no update except the message "Response to request for evidence received, and case processing has resumed"
Couple of days ago my concurrently filed I140 has been approved. Now my question to the experts is:
1. What will happen if the e-filed ones get denied?
2. What will happen if the e-filed ones get approved?
3. What if the USCIS notices two I-140s for the same employee and from the same employer?
