my earlier post got deleted by mistake.
Anyway here's my story , I applied for I-140 thru premium processing and at first some months back i got an RFE.
RFE was mainly about asking some more past years tax information of the company.
We promptly replied to the RFE and i got a denial stating that tthere wan't clear evidence about ability to pay the employee for the year 2002 , 2003 etc..
The funny part is that there were almost 7 employees for which I - 140 was applied and all of them got approved except 2.
What a pity.
Well appealed to the denial with some extra information. but came to know that appeal normally doesn't work in your favor.
Is that true ?
Further contigency plans were to refile new I-140 petition in which lawyer said that there are again slim chances of I140 approval. Although he also said that new I-140 and denied I-140 is not connected.
so failed to understand why there is slim chances?
What a major F***up. After all this painfull wait although not near to completion , i got a I-140 denial.
H1 expiring soon with in 2 months so to keep H1 alive he suggested to go for appeal which I totally understand.
Now my question is whatever slim heck chances i have i would definitely want to apply for I -140 again but can a new I-140 be applied while the old one is appealed.
Well kind of losing all hopes but would apprecite if someone could reply.
