Hi
I need some information about the I-140.
I have applied for labor.While applying for labor in the petition it was mentioned that MS is required and major field is computer related.
I have BS in Mech Engg from Nagpur University and MS in Production Engg from REC, India. I have served for almost 12 yrs in a educational institue before I came here. During this time I was a part of team which undertook software consultancy projects.
My labor was approved I applied for I-140 and I-485. Then a query was issued asking for company information and education evaluation, which was submitted. Education evaluation submitted indicates my experience and also states that i have BS and MS.
Then recently I got a notice a notice from INS stating that my I-140 is rejected since my education evaluation does not talk about my MS and it is not computer related. However I was given a chance to appeal within 30 days.
I would like to know what can be done.
