I-140 Denied. What are my options?

My EB-2 I-140 has been denied at TSC.

Reason: My labor Application(ETA-750 line 14) says 2-years Experience with 2 years in relevent field. Labor department says this means 2 a total of 2 years required. The INS officer says this means 4 years required. I have just 2 years.

Anyway my lawyer is appealing. What are my options, Chances? Can I start I-140 again if appeal fails with the same labor approval.

My 6 year H1 runs out next year. Can I renew seventh year?

Hey Sujeeth,

I was just going thru I140 denied cases .. found that your case can be similar to mine in future. I am going to apply for 140 next week with labor substitution. the labor says 1 year + 1 year (relevent exp) . Till I saw ur case, I thought it meant total 1 year exp. .. now I am scared. Please let me what happened to ur case or any info on this??

Guys,

I been through this, I-140 got denied and appealed and finally got approval from AAU. My case was similar to you guys. I was in EB2 and ETA form said the job requires MS+3 years OR 3 years of related experience, TSC denied the case saying it means it requires MS+6 years in total which is equivalent to BS+8 years and I had BS+6. My lawyer fought hard and got it approved but I lost 8 months in this whole process. I was lucky that AAU just decides my case in less than 2 weeks which was amazing....

After 19 months in waiting, my I-140 got denied due to the company issues. Did you go for Motion to Reopen Or AAU?
if you got your approval through AAU then what happened to Motion to reopen? what was the result?
