My 140 and 485 applications were denied because the lawyer filed the same labor substitution for someone else. I work for a big company and they have many labor substitutions and lawyers claim they didn't notice that it was used for my application.
Now what's weird about this is that my application was done first. And some other application was filed 3-4 months after my application with the same labor substitution.
Shouldn't USCIS deny the second case? Do you know of any reason why the original case was denied? Now the lawyer is willing to withdraw the second application, but can he do that? Is it now too late?
