I-140 denied from TSC

Hi !!..

I am stuck in a loop of INS error. My I-140 EB+2 got denied at TSC, the
reason being my qualification doesn\'t match with the certified Labour
certification, which is not true. They read the ETA form incorrectly
(they read MS+3 OR 3 years of related experience to MS+3 AND 3 years
with a total of MS+6 equiv of which is BS+6 where as mine experience is
BS+6). My lawyer managed to get a certified letter from Labour deptt
saying they are mistaken in reading AND with OR.
We filed a Motion to reopen but now after 6 month they forwarded my
petition to AAU.

Where I should I complain, they took 1 year to process 1-140 that too
with this kind of error. It\'s very depressing and I will really
appreciate if someone could help me. My lawyer is a member of AILA and
he is seeking help from AILA but I don\'t know how long it\'s gonna take.

Can you please advise me how AILA can help in this and in what time
frame. This is such a stupidity where I am paying for someone else\'s
error. I work for a company with 165,000 Employess and working on a
federal agency contract.

Can I recoop all the time I lost. I am going in such a mental depression
right now and don\'t know what to do. I have bought a house and spend a
lot of money with a hope that I will get permanent residentship but
nothing is working out. My wife is graduate with lot of valuable
experience which is being wasted sitting at home, which is very
frustrating. I want to contact higher authorities and let them know
about all this. I have all the denial papers, motion to reopen papers
and letter from Labour deptt saying they are wrong.

Your message is not clear.

If the LC said MS+3, and you only have BS+6, you are not qualified. You will have to do new LC. Although BS+6 can qualify EB2, it is not equivalent to MS+3. Please post the exact words in LC and your qualifications. I will be able to give you clear analysis.
