I 140 denied because DOL couldn't retrieve a copy

Hi

I filed my 140 and 485 concurrently 2 years ago with copy of the substitution labor. It has been pending since 2 years with out any update. I contacted my local congree woman 6 months ago and they got a response from USCIS that they are waiting to get a copy of labor from DOL. The DOL communicated to the congree woman's office that they do not have the copy since 5 years past, since the approval of the labor. But I filed my 140 after 4 year and 2 months after it's approval. Now I got a notice from USCIS saying that they intent to deny the I 140. Anybody has any experience like this. Any information will be helpful. Please help!!!!

contact a good lawyer ASAP

thats the best advice I can give you. USCIS has been known to misplace documnets..they also have unnecessarily sent Intent to Deny only to retract when adequate proof is provided.

contact a good lawyer ASAP and you can sort out the problem (hope you or your lawyer has a copy of the application sent and the receipt number and so on)
