I 140 Denial, Post your experience

All,

If any one who had -140 denials can post their details, it will be of great help to the people going through the same phase.

Please post details like, reason of denial, approach you took etc.

I once again request to post your response.

Hello,

I applied labor in EB2/RIR category and got labor approved.
I filed I-140 and got a RFE that "Do we want to continue in EB3 category".

I have three years degree, two years computer diploma from NIIT and seven years of experience.

Attorney replied that we will change it to EB3. INS has sent a mail that I-140 petition has been denied because I have 3 yrs of degree.

The petition required a US Bachelors of Science (4 yrs ) or foreign equivalent and five years of experience.


I request every one who had similar experience to post their details.

Did you get your degree evaluation done here in USA as equivalent to 'US degree' ?

Has your I-140 also rejected in EB3?

I have seen posts where the INS is not accepting educaiton from NIIT as it considers it vocational. Check out the previous posts, you might get some useful info.

Do you have any college level course work you can use, like classes you took here in the US or India after your bachelors degree? That might help.
