I-140 Denial- Please Post Your Experiences---

All,

If any one who had -140 denials can post their details, it will be of great help to the people going through the same phase.

Please post details like, reason of denial, approach you took etc.

I once again request to post your response.

I checked my case online, and it said it has been denied. My RD is 2/25/2002, the denial decision was made on 09/20/2002. I have not received the paper work yet.

I think the reason is:
My lawer made a mistake. My LC is EB3, but by mistake my lawer marked "advanced degree or extraordinary ability member" which is EB2 for my 140.

So, it is not possible to get approved. I knew this problem one month ago and my lawer sent a withdraw letter on 08/22/2002. But it seems INS did not withdraw my case and still processed it and denied it on 09/20/2002. I already re-filed my 140 together with 485 (concurrent filing) on 08/27/2002.

Will this affect my new 140 and 485 application?

Hi Jingzhi,

Sorry to hear about your case!!

It's ALWAYS attorney's mistake...they never do their homework before filing the application...and we suffer because of their mistakes......

What's your approach now.

Even I filed my I-485 application (Concurrently) and it was returned by INS.

did you file a new I-140 with 485

Are you saying that because your old 140 was denied and then you filed new 140 together with 485 (concurrently after your old 140 denied), and your new 140 and 485 were returned by INS?
 
I did not file my new I-140 yet.

I filed my I-140 in March 02, and I-485 in Aug 02.

My -140 was denied sometime in September first week.

Last week my I-485 application was returned because I-140 was denied.
