I-140 Denial, Does not make any sense!!!

Dear Friends,
My I-140 petition got denied due to some reasons regarding the company, after an Investigation (Nothing regarding myself or my degree or Experience). We have filed for the Appeal and waiting for the response from Texas Service Center.
Meantime other people from my company are getting I-140 approval, I-485 Approval and FP notice etc. It does not make any sense to me. My case was denied due to the company problems (of course there is no problem) and I am only the victim here.
If there are any rules or laws, it must apply to all the people. Not to some people or depending upon the Officer. What are my options here, if my appeal is forwarded to AAU by Texas Service Center. Kindly help me. I have lost more than two years due to an inexperienced officer and I am approching my Six years H1B limit soon.

Mr.Jim and Other Gurus, kindly share your views.

Thanks,
Naanshi

Specifics....

naanshi,

Sorry to hear about your I-140 denial. Could you post exact specifics of the reason for the denial (you mentioned that it was due to some reasons with the company)....

Posting the exact reason would bring in some thoughts and suggestions to you as well as others to be cautious about the same.

Good Luck on your appeal.

If there really is no problem and it was clearly an error you should have filed a request to correct a service error. I have suspicions that either you are not being given all the information or that the case was denied because a poor response was provided to an RFE. RFEs must be taken VERY seriously and every question must be addressed.

An appeal will take a year or so (maybe two). You need to discuss all of these issues and your concerns with your attorney. The attorney has all of the documentation, knows precisely what happened and why and should have a plan regarding what do do and how to address your concerns.
