I140 puzzle

Our ND for filing I-140 is June 14th 2002. Ours is a labor sub. We have not yet got any info reg. our I-140.
Engaged a Senator's office and the info we recvd from them is as follows:
As this is a labor sub, the earlier beneficiary had opted for counslar processing - Mumbai Counslate. Now the VSC has requested for info from the Mumbai counslate for the original Labor appproval. Mumbai Counslate has not replied as yet.
Our Senator's office and our Lawyer has also emailed and faxed Mumbai Counslate - no reply. Also checked with the beneficiary if he did use the Labor at some point. He has not and has applied for GC thru another company and confirmed that he has not used this Labor.
My status is as follows:
8th year H1 - approved (until Nov 2004)
Have EAD - expiring on dec 2004 (2nd time)
Have already done FP last year
WHAT SHD I DO NOW
