I-140/cp/i-485

Hi all,
I found this foruim through the web search and it seems like a perfect place to find great information about GC issues. Currently my I-140 is pedning approval. RD is 05/14/2003. Any idea when I could expect a reply? Also I am torn between CP or AOS. My company is not in a very stable state, but the situation might be better than I suspect. Do we know how long it is taking to get an interview date after 140 is approved? Are there any hidden issues with AOS like losing the job while on EAD. How long can you be without a job on EAD. Also does your I-140 have to be approved before they start the clock for 180 days (for AOS portability)? I know that is a lot of questions but I will really appreciate any information. Thanks for your time.

I can attempt to answer some of your questions, although there are people on this forum far more knowledgable than me who can help.

How long your I-140 will take to process depends on two things: 1. The service center you are processing through and 2. The subcategory of your I-140 (i.e. EB1, EB2, NIW, EB3 etc..). You should use the "Processing center times" link on the main page of http://www.immigration.com to determine when to expect your I-140 approval.

Also I am torn between CP or AOS.

This is really a tough call. People have their own preferences and you will find arguments supporting both sides. I chose CP, becuase there is no doubt that it is faster (actually much faster) than AOS. Currently, here in California I-485 is taking 1.5-2 years vs. 5-9 months for CP. However AOS has definite advantages over CP in terms of getting EAD and not having to exit the U.S. in order to obtain your green card. Spend some time reading the older threads on this board - and you will learn more.
