I/140 - Concerned on specialization since my Engineering "Textile Engineering"

Hello Immigration GURUs/United_Nations

I have applied for I-140/I-485/EAD/AP on Dec 29 2004(Fed ex received by INS). Filed in EB3 category with California Service Center.

We have used a Pre approved Labor for this and Labor description was :

1. "B.S in Com-Science/Electrical Engg/Elect Communication Engg or related(4 Years) (No other description)"

(Iam concerned on specializtion since my Engineering "Textile Engineering", We did give a Eval from trust forte)

My education:

1. Bachelor of Engineering in "Textile Engineering" (4 Years) --
2. Diploma in Computer Applications (1 and 1/2 year)
3. I am a Sun Certified Programmer.
4. I have 4 Years of Experience in IT and it exactly matches with the pre approved labor.

HELP NEEDED:

My Questions:

1. Do you see any issues with Field of Study not matching(Specially in the field of the study).

2. Any reason you see that result in denial/rejection of I-140/I-485

3. If my I-140 gets rejected, How much time will I have before I go out status?? And How much time will within I have to leave the country??

4. My H1-B Visa is getting expired in July 2005.

I truely appreciate if you could provide me the detailed information on these questions.

I am not so sure but it seems unlikely that "Textile engineering" will be considered as a field related to EE or CS.

Thanks much for valuable inputs/suggestions. I keeping fingers crossed at this time.

Unitednations, you mentioned that I could a 7th year extension, I was wondering if how this is possible. Because we have applied for I140/485 just 20 days back (Dec 29th).

Are these application have to be pending for 365 days to get eligibility for 7th extension??? Can you please provide some details.

7th H1B Year Extension based on Spouse's I140/I485 pending

Hello United Nations,

Thanks a lot for your earlier reply. But I guess I did not give complete context before.

The current application is applied for "my spouse". My spouse's company has applied for EAD/AP/I140//I485 in Dec 2004 with Substu labor(Apr 2001). Now we(me and my wife) got our EAD/AP approved this week.

But I want to extend my H1 for 7th year based on my spouses pending I140/I485 cases. Labor substitution(PD-Apr 2001 and approved in Apr 2004)

Am I eligible for 7th Yr extension?? Could you pls share any experiences around this?

I truely appreciate your inputs/suggestion on this
