I-140 & Changing Employers Dilemma

Hi All,
I have my EAD card and it was a concurrent filing (I-140+I-485).
It is well over 6 months this filing is done. My question is "Can I switch employers while my I-140 is still pending, though I got my EAD card"?

Thanks a lot.

If you are willing to use AC21, you should wait till your I140 is approved.
As it is, GC application is for "future employment". So, it makes sense to prove that you are willing to work for the current company once you get your GC even though you are leaving now to join another company.
I think it is safer to wait till you get your 140 approval. I am no expert in this matter. Some GURU is here should be able to give you an accurate response.

Good luck.

yeah,
I think you should wait till I140 is approved.
I am also in same dilemma.
I have a very good offer and my I 140 is not approved.
Its RD 09.08.02
I even talked to INS officer and he also said I should wiat till it is approved.
But if you employer is ready to continue your process or ready to respond to RFEs then you may think of it.

Thankyou to both of you for replying to my question.
But Iam in a strange dilemma. My employer could'nt find an assignment for me and told me that I can look around on my own and said that they will continue processing my GC processing.

Iam planning on joining another employer. Will this affect the renewal of my EAD card ?

Thanks a bunch in advance.

Praise thine employer!

Seriously you are lucky to get such a good employer. As far as your employer could support your GC process you can look for another job.

By support I mean, in case a RFE is raised your employee will receive the RFE. Your sponsoring employer should reply to the RFE in a timely manner. If the employer promises to do so... you need not worry.

This will not affect your EAD / Ap renewal nor your GC process.

Thanks for the info.

But I have the following concern: You meant to say that any RFE's as they come along, should they be handled by my GC sponsoring employer or my new employer ? Does my new Employer has any role to play in the GC processing?

Also since my I-140 is still pending, will I face any issues if my new 'Job Description' does not match with what was filed for my GC ?

Thanks.

"job Description" would play rolw even after your i-140 is approved, AC21 law says that new job must be under same category, donno if it has something to do with job description or there are certain job codes under which we file our applications, but it sure that changing employers on EAD/AC21 is bit unsafe before I-140 is approved.

As far as RFE's concern, I guess, on I-140 level, there are possible queries about sponser,s o he would have to reply for them, but on i-485 level i guess queries are specific to you and not the sponsor so you will have to reply them.

hope this helps.
