Hi.
Today i checked my online status and saw that my case was approved on Nov 4th.

I had filed initially on Jan 9th EB3. Got RFE in August, replied back by Oct 9th. RFE was for a bunch of things
1. employment proof in previous companies
2. education evaluations
3. W2's

BCIS took about 20 days to process the RFE.

Happy about this, atleast one less thing to worry about.

How did u provided proof for employement in previous company? did u submitted company letter or anyother thing? i am also might be in this situation, because i dont have 1 exp letter form previous employer and that emplyr has closed his business. also did you provided any experience letter from current employer before you filed for labor and I140?

I was asked to provide the same thing. For the place I worked seven years ago, I provided a letter from my previous boss. For the one it is still exist, I got the letter from HR. It worked fine with BCIS. My attonery indicated first choice letter from HR, second choice your previous boss, the last your colleague.

RFE details:
I had worked for 2 previous companies. One in the US, the other in India (bangalore).

The US company had ealrier given me a letter of employment, but BCIS wanted my duties in that letter in addtion to title, salary, term dates. They also wanted the name/contact info of someone who validated that information.

What i did was that in addition to getting info from the HR dept, i had my ex-colleages, now my friends, sign and notarize letters that stated my job, my dutues, my employment dates etc. and also provide their contact information. I provided 3 per company.

My bangalore company completely closed down. I submitted copies of my tax papers, offer letter etc. anything that had a date on it and was orgiginal from the company. I also got my friends form that company to write letters for me.

So, i did submit a lot. Key takeway for you guys is:
1. even if the HR dept is closed, get letters from former employees - make sure they are notarized.
2. provide copies of paystubs, tax forms that indicate that you were working there

make sure all employment letters list your job duties even in simple terms.

Hi Lcauser,
I saw your case earlier - you got rejected for educational evaluation.

I have a 4 year CS degree from an IIT. That is about as clear cut of a case as can be. So.. the laywer had dealt with cases like this, they have a education evaluator they use often who is good, he provided a couple pages of evaluation.

I got new lawyers (company changed lawyers) and the old lawyers who filed the I140 did not do a good job of sending in the educational info - hence the request for it.

I am not sure if i can provide letters from previous employers if i am ever asked to submit. I worked in a country which is not my home country nor the US. It's very hard for me to get one. Scary......
