Hi,

My I-140 approved within a month time frame.
I am planning to change the process from Consular process to Regular, if
I-485 visa numbers available from October...... Any comments/suggestions please.

Hi kkt_tkk,
Are you from retro affected countries? If you are, could you use your first PD?
Or, will your CP GC have impact on your pending first 485, or your pending first 485 have impact on your CP process? Thanks for your reply.

Yes, retro effected country, India.
May be I can't use 1st GC 485 PD for this new I-140 approval. These two processes from two different companies.
No effect b/w two I-485 (2-GC) processes, these two are two seperate entities and two different companies, as per my attorney.

Thanks for your reply. On your second GC form--I'm not sure if it's still called 485 since you file through CP, did you put previous 485 information on it?

Yes, attorney mentioned my previous(1st GC) A# number in that.

I am planning to convert this 2nd GC from CP---> Regualr, so I will apply I485 once current in OCtober 1st.
We don't know what will happen once visa numbers available in October, they may close within a month or days or ....
If,
I-485 apply, I will get EAD and may be 485 process will continue, if still visa numbers are available or I will renew my EAD card.
CP: If visa numbers will open for long time(I don't know how long), then this is ok. If visa numbers closed within 2-3 months, then nothing with CP.
Asper my attorney, from state department they got the message that, likely from October visa numbers current for EB3 also.But how long they don't know.

Thanks for your information. I wish your 1st 140 approved then you can use your 1st PD, preferrably 1st 485 approved then you are all set.
