Your attorney/employer will have the approval notice some time early next week, am saying so based on my exp, do let us know when you recv the same. ALL THE BEST ....

Thanks

It depends. I think it will go to your lawyer.i would say anywhere between 2 to 4 weeks by the time your lawyer notifies your Employer

Did you get any RFE??

I don't think it will take more than 2 weeks. In that message it says "If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283. " .

Today I called my lawyer. They havn't received at. I am expecting in next 3 or 4 days(to my lawyer).

Thanks.

I got RFE on education evaluation and previous employment letter.

RFE dt: 12/20/2003 (approx.)
RFE replied: 01/21/2004

Its so unfair.

I do not know if the illegals comparison is OK.
But sure, it is very unfair. Logically, applications filed properly should be immediatly approved and those with RFE after getting proper RFE reply.
But that is only if USCIS works logically.
And there seems like only one logic in USCIS working- "Illogical".

Hartik,

If you want unfair, go look at the processing times for EB11 and EB12, the so-called first priority job-based 140s. Many applications have been pending for almost 2 years while those of EB2s and EB3s are getting processed routinely!

well said Reverse_Man

Having the immigration experience of Canada and Australia, and now seeing US immigration I should say that process followed here doesn't have logic in any steps. Australian and Canadian immigration rules are very fair and well implemented. I was under the impression that if an individual is talented, USA is the place where one gets due recognition. I don't see that reflected in the way EB1 and NIW cases are treated and also some extent with EB2. I am glad that I didn't apply in EB1 even though I have a PhD.

It appears that current US immigration needs are at unskilled worker levels. Does this mean the superpower is on the verge of decline?

This is NOT to start a flame war. Unskilled workers are professionals too. US is a country which was built by the immigrant community who were laborers. Since a country doesn't need PhDs and doctorates doesn't mean the country is in decline. I know that Immigration in this country is gruelling and is not a science. But don't throw your frustrations on others, rather wait for your turn.

A person who applied for GC have to wait a MINIMUM of 5 years a decade back. Now many get their GC in about 3 - 4 years. Don't blame others for your ill fate.

The anology is not fair. Don't assume that all those who got RFE did not file properly. What is unfair here is the UCIS/INS employees attitude. I think these UCIS employees are not capable of doing things right. So I think they should outsource this work. Then we can all get our green cards in three business days:)

dynabuoy - no need for flames!

There is no need to start flame wars. I haven't posted any meaningless messages since becoming member on this portal. I have better things to do. I was just stating the fact. Always facts are difficult to swallow.

Whether we like it or not, facts remain. Only time will tell what is good or what is not. We are not here to pass judgements.

Rajiv has given a good forum to exchange ideas. Let us just use it for that cause.

I was just bringing the inefficiency (which we all know) of the system. If there is a rule that EB1, EB2 and EB3 will be treated differently, let the USCIS be courteous to publish. They won't do it because of litigations that will follow in this free country.

Dear rajudm

I think I haven't stated my views clearly. I know that you were sharing quiet a lot in this forum and contributed a lot.

My only concern is that the views we express should not hurt the feelings of others. Remember those in EB2/EB2 categories are our friends too and they too go through the same frustration.

ASAIK USCIS uses a weight system and allocates resources based on the number of applications they receive. It is true that most of the applications received are in EB2 and EB3 categories so more resources are allocated to those cases. Due to this there is a huge pile of backlogs of EB1 compared to the other categories.

Also most of the companies (and beneficiaries) want to play it safe by applying in EB2/EB3 categories as there is a 'belief' that EB1 categories undergo tougher scrutiny compared to others.

I know it is very frustating, but we can achieve more by congratulating those lucky souls and wait for our turn.

Hope you understand my point.
