You can but make sure you get a good lawyer and invoke AC21. There is nothing that can prevent you from using AC21. Good Luck.

Congrats on your 140 approval,

I think you can use AC21 only after 180 days from your 485 Reciept date.

I am not sure about ur case. u got 140 approved in just under 3 months.

I am eagerly waiting for my 140 & EAD.

no,he got approved in 11 months and not 3 months, mine is also spe 2003 date, got the ead but nothing so far for AP or i-140

I have a question to dede_GC

I applied my 140 and 485 on Sept 2003. I got a query on 140 in November 2003 about my education evaluation. It was been answerened in Jan 12. Till now I didn't get my EAD !!!

When did you get your EAD. Before RFE or after RFE !!!

No I haven't recd EAD,

I was kinda hoping 140 & EAD both clear before Feb. From March I can switch the employer using AC21. I need it very badly becoz I already got an offer. I do not want it let go because of my 140.
Mean time,
I called BCIS they said you can go to Newark and collect I-EAD, but no Guarantee that you will get it.
I might go to Newark office next week for EAD.

Hopefully this might trigger my 140 approval.

Why did they ask for an education evaluation ? Do you have a 3 year degree ? If its a 3 yr degree, then how did you answer. Did the labor ETA 750 required you to have a 3 year or a 4 year degree. ?
