I-140 approved. RD:09/2003

Friends,

Here is the Post of my happiest moment....! Yes, my I-140 got approved y'day and got the Magic emails today....! So I am half way thru....!

Pl. see my signature for the details. Do I still need to apply for 8th year H1 extension ? My current H1 is valid till 03/29/05.

I am really thankful to you all for all your help.

If you have no EAD in hand before 3/29/05, you'd better file extention since you can not work without either H1B or EAD. Just make sure you file H1B extention Before the expiration date if you do not get EAD approved around that time.

I have an EAD approved as of 12/09/2004. But my employer and attorney are still insisting to applly for the H1 extension.

I am just worried as it would cost me around $3000 for H1/H4 combined and employer is not willing to pay ....! :confused:

I am in exact situation like you and I am not going for an extension.

I also need to make a decision...! I am plannig to go on vacation in June to India. In that case the extension may help me .....!

I also wish the same that all waiting since 2003 should get their I-140s approved....! I know what it feels like ...! :mad:

I did not notice you have EAD already.

If you start to use EAD, You need to file I-9 form with your employer. you have to manage the renew process in time (3 month-6 month ahead of expiration date). You can not work if the renewed EAD is not available after the existing EAD expired. Of course, if after 90 days of your renew EAD application date, you still did not get EAD approval, you can apply I-EAD from local INS office through Infopass web.

If you continues to use H1B, which is expensive but as long as you file before the expiration date, you do not need to worry about the eligibity of working. You also have H1B status to back up in case your I-485 is rejected (very unlikely though if I-140 is approved)..
