I-140 Approved . PD March, 00. Should I file for I-485 or wait till my PD becomes current. Help appr

Those guys filed for I-485 when it became current for everyone in Aug-99, I believe it was current for 6 months....
My PD is Jan 99, EB3, ND October 99.
I filed my I485 in october 99 because dates were current then but retrogressed after few months.

people who have EAD AP & now waiting for approvel file for I 485 back in 99 when PDs were current for some period & then retrogressed.you have to wait for your PD to be current to file for AOS.Thats not much of a option as Bhanu said above.

Bhanu or anybody else do u guys know how they verify for PD. I am EB3 born India, wife was born in Sri Lanka, my PD is 03/99, I applied on the basis of cross charge-ability in July 2000, both of us got our EAD\' and AP\'s, any clue at what step they check for PD to be current, is it when they get the A# or later.

They go by ND and every month they verify the people with those NDs if they have the PD current or not. Hope this helps

So technically speaking I could apply for 485,EAD,AP even if PD is not current, get my EAD & AP as they might not check the PD at that time and wait and take the risk to see if my PD gets current, and if it doesn\'t get current when they process the 485 I get an intent to deny, basically add more confusion to the whole process right.

the only catch there is that EAD/AP must applied while or after I485 is filed. So, th bottomline is you have to wait for PD to be current to do no matter what. After then, the processing of AP/EAD is independent of I485 as you probably know.
