One of my friend has his I-140 approved in Eb3 despite applying in
Eb2, He has already got his EAD and recently he realized
that his i-140 is approved under EB3 category, He spoke to the IIO
and attorney , the Immi officer asked him to fax all the approval
copies which he has done on Friday and awating the result.
The most important thing to be noticed is he has not recieved any
RFE nor anything during the I-140 process and was happy to recieve
the approval which he has not noticed about 8 months ago and
applied for his ead, he recieved his EAD also and also applied for
i-485 which is under process now, Can any one tell us what would
be the repurcussions because of the above,Any suggestions will be
highly appreciated.
Can INS approve the Papers under EB-3 Category despite applying
in Eb2 without any RFE.Thanks for any input
