Hi anushri,
My I-140 approved on 4/23 and few weeks back I have applied for I-824. I applied for PCC on 4/23 at SFO.

What is your status ? What are your steps now ?

Thanks

Hi VM1214,

My I-140 is approved on april05 and in 15 days NVC has entered my case in their system.I am waiting for them to send the fee bill.
Well i cannot apply for PCC right now as i have to apply for new Passport in MAy04., my PP is expiring in MAY05.
I'mm planning to send the fees to my attorney today so he can send the fees as soon as he receives the fee bill.
So that's all from my side.will keep u posted with the new developments.
Hope we can be in touch thru the process.
If u have any questions or comments please use this post, so everything will be in post and easy to track.

You need not worry. I would not apply for the PCC unless the lawyer wants to see it before P3 is sent.

Hi alren,
We need PCC anyways so will it make a difference if anushri and I apply now (before P3 arrives and submitted) ?

And can anushri apply for new passport and PCC togeather ? as the new passport need police clearance also ? am I right

For you, since your 140 was just approved, Optimistically you would get the interview in August time frame. But if it slips then your PCC might be approaching the 6mo validity (presumably reqd. by US consulate). You might have to apply again.

For anushri, Again Optimistically (with 4/5 approval) expect the interview date in October same issue. If you already have a valid passport and you renew in Indian consulate in US, it takes about a week (No lengthy Police clearance reqd.). I remember KD1403 mentioning somewhere that PCC with the new PP application will be based on the old p/p and will be based on the from PCC in India (1 - 1.5 mo. timeframe). But based on the newly renewed PP it will take a week in the Indian consulate.

alren:
VM asked the question for me. Can i apply for the new passport and pcc together.
secondly, my present H1 visa is stamped on the current PP. Keeping in mind My PP cannot be renewed (as it has "F" marked which means final and cannot be renewd as given on the embassy website) and they have to reissue it, are they going to cancel the visa or can i request them to issue a new PP and keep the visa intact in the old so that i can use it.
By the way, Can i use the Visa from the old PP.

Any idea on this from anyone.

VM:
I guess u know that PCC should not be more than 6 mnths old at the time of interview. Keep that in mind.

Hi anushri,
As far my knowledge your visa will be restamped on you new passport if it is in valid status.

Yeah I am aware of six months time frame but I am keeping positive attitude of getting interview called within six months (Of course with god's grace)

One more news from my side, my I-824 got approved this afternoon, I got an email confirmation from USCIS. It was filed on 04/09 and approved on 04/26.

Thats all for now.

Thanks

Indian consulate will not cancel the visa (I'm not sure even if they have the authority to do it). What you will have to do till your CP interview is over is to carry both of your passports while travelling. Yes, you can use the visa if the visa has not expired.

You do not need to do any special requests. They will send (and you make sure) the old passport back.

Expiring Passports

Anushri,

I do not know the details of your case, but here goes. It is advisable to apply for a new passport before the old one expires. Indian passports can be renewed if they are to expire in the next 365 days. Once a passport has been issued, obtaining a PCC is very easy if you are applying to the same Consulate/Embassy. For example, if your new passport is issued by CGI San Francisco, then at a later date you can obtain a PCC within 4 days by courier, or the same day if you go to the consulate personally. I mailed my wife's passport on Monday and received the PCC the day after, on Wednesday (all by courier).
However, if you plan to, or have to, apply for a PCC at a different mission, then it takes more than a month (at least that was my experience).
