I 140 approved for CP applied for AOS.. Please advice

Folks,
Here is my situation. My I 140 is approved for CP now I have applied for AOS in April. My lawyer had already sent packet 3 and Mumbai US consulate. My lawyer didn\'t send my original I 140 with packet 3. I already got interview date which is end of this month. Due to workload I decided to do AOS in US which my lawyer filed last month.

Now I came to know some of the postings here that says I have to write letter to NVC as well as I have to request my documents from Mumbai US consulate which NVC had sent to Mumbai US consulate . Can any body tell me what documents I have to request from Mumbai US consulate to send back to NVC ?? Also I am not sure about should mumbai consulate send back to NVC or INS because I 485 is processed by INS?? Please help me out. I am totally confuse. Forgot to mension I have zero help from my company\'s lawyers as my company is cheap and doen\'t want to have direct access to emloyee Please Advise.

Hi,
Well you can\'t do much to speed up the 485 process. Once the papers are sent to a consulate abroad only the processing centrer i.e. in this case VSC can request the papers back.

I am in a similar situation and I applied for 485 in Feb 2001 and still waiting for approval. VSC requested back my I140 papers from Mumbai consulate on 16th April 2001 and Mumbai sent it back on Oct. 16 2001. This I came to know by sending an email to Mumbai consulate. But now I guess the problem is that they have not put all my documents back together in one file.

I have seen some people getting approval without any delays even when their I140 was approved for CP. But I have been stuck for a while. I feel that if you can go to India and get CP done its better rather than hanging for more than a year.

Thanks for you reply. your answer was really useful. I was all ready to go for CP but at last minute my company changed it mind because of workload and refuse to give my I 140 which was with lawyer so that option is closed for me unfortunately.
One point I didn\'t understand here is did you send your I 140 with Packet 3?? What are the papers needed from Bombay consulate Could you please clearify this?? If you don\'t mind please give me your email address

Question for 485 runner

Did u ever call IIO reg your case and asked why it is taking more then the normal time as all your paper work is with them .

 I am also in the same boat , INS has requested for my paper work to be sent back and they received it 4 weeks back. MY RD is in july and I see fellow July cases being approved.
 
I don\'t know a whole lot about Packet 3

I came to know just recently that my 140 was approved for CP by comparing it with one of colleagues 140. My lawyer never told me anything about Packet 3. I just called NVC and provided them with my I140 EAC number and then they gave me a number starting with BMB and told me that me case was sent to the consulate in Mumbai. Using the BMB number I sent a mail to Mumbai consulate and they replied that my I140 papers were sent back to VSC.

I have called INS a couple of times and only the last time did the IIO told me that the problem is that my file has not been compiled as yet and they would do it soon. I guess we can\'t do anything except for calling them once a month.
