I-140 approved today (received the written notice today), however online still says processing...

rest of your all waiting here for I-140 - Be patient - things will work out .. just FYI for the guys whose Companies are not doing well financially, my company had a terrible fiscal year last year but the passed my I-140 anyway. Our company is 6 years old and not too many employees - around 19 but much fewer now..

I applied for my Green card 5 years back and now crossed the second hurdle.. and living legally in this country for 11+ years now.. F1 visa to EAD to H1B visa (8+ years)... patience pays off finally!!
 
Congratulations Ravi for getting the I-140 Approved - the ultimate climax in getting a GC (I-485 is just a formality and it will be approved unless if one has serious problems). Your news is really encouraging for all of us who are facing with the company's losing financial position.

Can you please help us in posting what exactly the RFE is and how did your lawyer responded to the RFE? What documents did you submitted in RFE? If you want to communicate with me privately, you are welcome so and I can even pass on my phone number so that we can communicate offline? Please help!

The first RFE was for Certified Financial Taxes of our Company for the past 4 years (1998 - 2001)... when we received the RFE in August, I went with my president to the local IRS to get the tax returns. They gave us only 1998- 2000 and said that they had not even received the tax returns of our company for 2001.

So, our company had to file the tax returns again and the IRS said it would take around 2 months before they could issue certified tax returns. Well, we made a loss for the first time in 2001... before that all years were slightly profitable only (around $50K) on paper even though revenues were as high as $9 million for 2000.

After two months, since we did not respond to the RFE, we received another RFE again saying they needed certified tax returns and also my official diplomas etc.. from my school in Oklahoma where I did my MBA. I had not officially graudated as I did not pay the feees for the last semester in 1994 and did not bother.. I paid them finally in 2002 June and with a lot of pursuasion the Dean let me graduate as 2002 Graduate but I still have not received the diploma (will come in Mar 2003). My Lawyer said this could be a problem so we waited till last date of RFE to reply (Jan 30, 2003) - Finally we mailed it on Jan 24th - the letter from my Dean saying I completed my courses but will graduate only in 2002..

anyway, it got approved before that.. hope this info helps!

man you are plain lucky.....risky behaviour to top it off. Wow, the first one I have heard...not paying tutuion even if it means no graduation....goodluck guy...and be more responsib;e in future!

Thanks for your extremely candid response and I appreciate your honesty and help! When you filed for I-140 application for the first time, did you submitted the financial statement or did your lawyer chosen the other option by sending the "Certification of Ability to Pay" authorized by your CFO? (Please note that the latter option is viable only if one's company has more than 100 employees).

I am in the same boat as you where my company is making financial loss for the last year. However, My company has more than 100 employees and is in business for more than 15 years and hence my lawyer submitted the "Certification of Ability to Pay" option signed by my company's CFO and I didn't send any financial statements. This is a real concern for me, since I dont know on what basis INS sends the RFE's. Some people say that INS has database of several companies and if INS has given approval for I-140 for previous employees of a company, then they will not issue RFE and will approve the financial position of the company. Anyway, let's watch this situation closely.

I expect viewers/participants of this forum to highlight this issue, since this is a most important stage in GC processing.

Hi all,

I want to see if you can give me some insight on wether I am ok or not in this scenario.

I am Masters with 7 years experience, recently got Labor approved. About to file 140/485.

My company has 27 -w2 employees and roughly has over $2 million in revenues.

This company exist for the past 22 years.
