I-140 Approved ,choosed CP ,can i file New H1 Visa for my spouse

Hi ,
My 140 was approved couple of months back and i choosed CP for my GreenCard ,so i will not get my EAD Card .

My spouse got a Job a now ,company is ready to file H1-B visa for her ,my question is can we file H1-B Visa for her,if so will it get approved ?

Experts please clarify .

u can file for H1 for her, but better make it before the cap expires.

the approval will be dependant on the merit of the application.

The fact that u have applied for CP should not matter.
