I got the magic mail that my I-140 has been approved. There is no word on I-485.

Detail:
I140--> RD:27-Apr-2004, AD:23-Mar-2005
I485--> RD:27-Apr-2004, AD: ??
EB3 Catagory

Hi,
congrates. what is your PD?
My RD for 140 is 16 th April 2004, but I did not get approval yet.
I would like to know that NSC is processing based on PD.

What is Ur PD...?

If Ur PD is later than State Visa priority dates -- currently its 01JAN02 ... does that mean that U may have to wait till Ur priority dates becomes current for Ur 485 ...

Ofcourse it would be Jan 2002.. you are looking at immigration numbers for the month of FEB..

And to answer your questions, based on the approvals being posted on this website, it seems like the retrogressed date is affecting only the individuals.. who are waiting to apply their 485s. Basically, NSC has approved many people's I485 in the past few months even if their PD.. is after the retrogressed date. You can go through the approval lists.. and figure that.
And the bottomline as to whether your particular case will be approved, depends on the officer who is looking at your case. There seem to be atleast 3 patterns people are following in case of concurrently filed apps.:

1.Approve 140. thats it. Nothing after that. Even if your priority date is before the retrogressed date.

2.Approve 140 and approve 485 if the PD is before the retrogressed dates

3.Approve 140 and approve 485 no matter what the PD is..

There are many examples posted all over this forum to prove all three patterns at NSC..
 
I wonder how many 2003 cases are still pending...

There was one Dec' 2003 approval today.
