Am I eligible for 7th year extension of H1, If my LC, I-140 were approved (after 3 years) and I-485 is still pending ?
I got a yes from a previous posting, but lawyer office says No. Please provide the section from the law (AC21 or other) that confirms eligibility for 7th year after LC or I-140 was pending for 365 days before end of 6th year EVEN IF I-140 was approved.
Here is more info:
- H1 expires April, 2005 (6th year).
- I-140 Filed (PD: 05-07-2001) and approved (06-10-2004)
- LC Filed Date: 05-04-2001 and approved after years.
- I-485 Filed Date: 06-23-2004
