I-140 approved, 3yr H1B ext in process - Question on Transferring Employers

Hi

My husband is on an H1B visa that expires Jan 2007. His current employer is sponsoring him for GC under EB3 - he has I-140 approval, but cannot apply for I-485 due to retrogression.

His employer has also filed for 3 yr extension of H1B under premium processing. My question is, once he gets this visa, can he transfer to a new employer and transfer the H1B, or does the 3 year extension only apply to the current employer?

We don't have to worry about the new employer sponsoring for a GC, since my employer is sponsoring me under EB2 (and I am in the worldwide category which is current) and PERM, so I should hopefully get my GC in a year or so, so as long as he can work on the extended H1, we should be ok.

Lucky your Husband.
I am in same situation as his- that is I am eB2 and i140 approved. My h1 expiring december and applied for 3 year extension. Want to change company after I get extension and stamping done. So if you get to hear any reply please let me know too.

Except that I dont have a wife - that can file for EB2 in ROW category. :p Hey I am open if you know someone of your status (minus married! ). :D
