I-140 Approval time for Substitute Labor!!!

Hi Friends,
I am not new to this website, but new to Nebaraska Service Center forum. My I-140 got denied in Texas Service Center due to Company Financial Problem and planning to file I-140/I-485 through a new company in Nebaraska Service Center. Any idea, how long it takes to get I-140 Approval for an substitute labor in Nebaraska Service Center?

sorry to hear that your 140 is denied,but mine is a sub labor too and got approved in 71 days.

I don't know what this substitute labour is.
Is it something like if I 140 gets denied then you can use
the labour to file I 140 with new company ?
Pl. Give the details.

hi naanshi, if you have 25 emoloyees then why was 140 denied on financial grounds. 25 employees is a lot and you should not have any problem. There were some who had only 2 or 3 employees and got 140 approval

Hi Patel,
Approved Labor certificate is the property of the Employer and it can be transferred to any employee, if the education and experience match. You can file I-140/I-485 directly with an approved labor of some other person, if the Employer allows.

I think I mentioned wrong. Company Financial was not the problem. INS went for some investigation about the company and came with lot of incorrect information. Based on that my case was denied. Anyway I just want to forget those and want to start fresh.

Substitution in I-140 means the Labor Certification was obtained
for employee 'A'.

For some reason the subsequent I-140 process is never initiated
for 'A'. (OR) initiated but still not approved.

In this situation 'A' leaves the company or is not interested to
pursue the GC

In this scenario, the employer can substitute another employee,
say 'B' in the process and apply I-140 for 'B' based on LC of 'A".

This is quite common and the INS looks for similarity of
education and experience in both the candidates.

Saves lot of time for candidate 'B'.
