I-140 Approval and H1B and H4

My employer lawyer is preparing to file I-140, I am on 7th year extension, I am planning for Consular processing ones priority date become current.

My question is ones I-140 is approve, Do I have to maintain H1B status for CP? Can I work for another company out of US till PD is current and interview call from consulate?

With CP one would not be eligible for EAD as also applying for transfer under AC21 (once the priority dates do become current).

IMHO, H1-B is the only way out for CP until the dates become current. Transfer of H1 would be possible, but when doing interview for the CP process at an embassy - what would one explain - that one is no longer working for the company sponsoring the GC ???

I would rather go the I485/EAD/AC21 route, if change of company is imminent- provided the dates are current.
