Hi all,
Would like to know if I-140 with concurent I-485 from NIW would be affected in any way if I change my current job on H1 after complted 3 years of J1 requirement. Will I have to reapply for new whole process of NIW.I am planned to move to new Hpsa with transfet H1b.

Great forum for guidance .
Thanks

I believe you can file an amendment to your pending I140 to reflect the change in the location of a HPSA practice. Don't know the details.

when you file an amendment to your I 140 does the time spent working on h1 count for the niw or does the clock start from the new approval date

Probably from initial change of status from j to H if you are j1 waiver.
You should do an aggreagate of 5 years in Hpsa.
Does anybody has experience in I-140 amendement for change of hpsa job in NIW?

- If you where never on H1b, the time clocks from the approval of the I140 (if you have to amend it or your dept of health letter, the clock keeps ticking as you have to prove an aggregate of 5 years)

- If you are a J1 with an IGA waiver, the clock gets backdated to the day you started the waiver in H1b status. Even if you change practice locations after following the proper procedure, the time in H1b counts.

It ain't fair ! And there was a lawsuit brought by Shusterman to address this unfairness. The goverment quashed it with some bogus argument along the lines of 'we are the goverment and therefore we are not subjected to judicial review. if we care to torture someone, that is our executive priviledge and there is nothing you little earthlings can do'. The judge unfortunately bought it and the suit was dismissed.

what if i got j1 waiver ,worked on h1b for 3 yrs switched jobs got h1b transfer aproval feb 06,niw aproval may 5th,ins is counting prior 3 yrs,if i switch jobs and file i140 amendment, does the clock keep ticking for the 6yr time limit, while waiting on the I140 approval?

Can u please provide update on your case? Were you able to find out information on NIW I-140 amendment for job change / HPSA change?

Also did you encounter any problem changing the H1b to new employer? I have heard that the H1b change will be subject to cap if it is not with the Cap-exempt employer.

I am currently serving my 3 yrs waiver. I am finishing 3 yr requirment next month. I am planning to change the job with a new employer (located in MUA) in different state.
