I-140 and H1 Extension

My H1 will expire on 28th Feb 2007. I will complete 6 years on H1 on that date.

My LC was filed after completion of 5 years of H1.

My I-140 petition was filed under premium process in December 2006 but has still not got approved as there were multiple query which has been asnwered. I am still waiting for the I-140 approval.

If the approval of I-140 takes place after 28th Feb 2007 can I still continue to stay in the US after 28th Feb.

My H1 extension application also has been filed but it can get approved only if I have an approved I-140.

Please let me know

You can take a vacation outside the country before the expiry date and claim that to extend your H1. Hope your I140 gets approved by then and you can then file for a 3 year extension.
