Hello All ,
This is my first posting ever in this forum. I have recently got my labor approved from delaware (took me around 8 months which is generally more than usual)and now planning to file my 140 and 485 concurrently. I have noticed lot of people have done this way so any one helping me out will be greatly appriciated.

Q1)I dont have the experience certificates from my previous companies so is there a way to get around this problem.

Q2)We did not had our medical exams and thereby not sure how long does it takes to get your medical exams done and generally how much does it cost/person. I heard that it can cost upto $500/person and differs from persons to person. Is there a way to get around this expenses?

Q3)Is it possible to apply for I-140 and then apply for the 485 in that case i need not to wait for my medical exams (as it may go anywhere between 60-80 days that i have heard).
Is there any issues related with this process(applying 140 first and 485 later on..).

Q4)I think advance parolee is valid only for a year, please rectify me if i am wrong.

Q5)At this moment i dont know if i should worry about how much time is it taking for getting I-140 approved hence no questions related with that. But certainly was interested to know that when you can file your EAD. Is it with I-485 or with I-140 just in case i decide to apply first I-140 and then wait for a while before applying I-485.

Just in case if anyone has gone through the same suituation that i am facing and is interested in sharing his views/experience that he has gone through will be of a great help to me and his views are greatly appriciated.

Some comments on medical exam. No, it does not take that long, our case, it only took 3 or 4 days, and it cost me $175, my spouse $130. (We are in New York) To save money, you can go to your primary health care provider and have all the vaccine shots which should be free. And if you know your TB is gonna show positive, have a X-ray taken and show it to the immigration physician.
As far I as I know, AP and EAD are both good for a year, after that you can renew them.
Experience letter can be from a previous co-worker. (That's what I have)

Thanks for sharing information

Thanks anxiousOR, I appriciate your posting.
Do you have a format that one needs to submit from a previous co-worker. I have worked for smaller comapnies and hence i dont know where my co-workers are right now. Does it really matter in a sense if i use their names in the affidavit and submit those. Does the Immigration department tries to verify any of those documents with the people and if yes how. Do i need
to submit their address and other stuff in the affidavit so that they can contact?. I dont know how it works so it
will be great if you can spread some light on this issue.

Also what did you mean with respect to X-ray....can you provide some more stuff on that as welll..

again thanks a lot for sharing the information.............

First of all, I need to apologize for misleading you, since when I re-thought about it, I did not submit "experience certificate" for my 140 and 485 filing. I did that for labor cert. So you might want to ask around and see what that is. Do you really need that? I know for sure that I did not have that in record.
TB is tuberculin test, a lot of people show positive, scine they had vaccine when they were little, so you need an X-ray to show that you are clear.
You file EAD together with your 485. Of course you can file 140 and 485 seperately, but there is this theory in this forum that BCIS actually process your 140 according to your 485 notice date. but it is not confirmed.

Thanks again.

Hello anxiousOR,
Thanks for the update again. TO my best understanding you need the experience letters while filing the I-140(as during this process they verify all the details that you have mentioned in the Labor certification. So i am pretty sure that you might have as well used it in I-140.

Secondly thanks for the xray information as i will get it done before hand to avoid the expenses.

It would be nice to if you wanna let me know some aspects where i should be really careful before applying as it will help me to avoid any mistakes.

Thanks again and would appriciate if others too shread their experience with respect to this process

FOR anxiousOR

What did u mean by "but there is this theory in this forum that BCIS actually process your 140 according to your 485 notice date. but it is not confirmed."

I have a ND of 11/5/02 for 140 (not approved yet)and I plan to apply for 485 some time now (after about 10 months of 140 RD) So based on what you said whats gonna happen to my 140 if I apply 485 NOW?????

As per the current trend at vermont my 140 should be approved in a month or 2. Will that get delayed is I apply 485 now??

I still dont get it, Does this mean that my ND for 140 changes to the ND of 485.......which means that I have to wait another 14 months from 485 ND for 140..... I have already waited 10 months without filing 485....Please answer this directly....thx

AzzKikr:

I know how agonizing it must be but what you said is apparently true. BCIS is supposed to process I-485 based on the RD of I-485. So that is the advantage of filing concurrent that your wait time goes also concurrent.
