I-140 Amendment

I am employee of company A who filed my LC and I-140 both of which got approved last year. I am waiting for my PD to become current to file I-485.

Only the division in which I work in company A has been sold to company B. Rest of the operations of company A remains the same. As a result I will soon become employee of company B.

Can company B file I-140 amendment petition and retain my original PD. :confused:. Will this cause any issues while filing for I-485.

Please let me know.

There are few options available.. depending on what is the actual case... worst case scenario file a new case altogether as you already have an 1-140 approved earlier you will be able to retain that priority date. Most importantly i would recommend you to schedule an appointment with your attorney as he would have a chance to go through your entire document and then advise.

The only relief you would get now is "You can retain the priority date" the rest relief after consultation with the lawyer :)
